Welcome to willdempseymusic.com. These Terms of Service (“Terms”) govern your use of this website and any purchases you make from us. By visiting or placing an order, you agree to these Terms. If you do not agree, please do not use the site.
1. Who We Are
willdempseymusic.com is owned and operated by Will Dempsey (“we,” “us,” or “our”). Our contact email is support@willdempseymusic.com
2. Orders & Acceptance
All orders placed through the Site are offers to purchase subject to these Terms. We reserve the right to accept or decline any order for any reason (including product unavailability, errors in pricing or product information, or suspected fraud). If we cancel an order after you’ve paid, we will refund the payment in full.
3. Product Information & Pricing
We make every effort to display product descriptions and images accurately. However, actual colors and details may vary due to screen settings or manufacturing processes. Prices shown on the Site are in USD unless otherwise stated. You are responsible for any taxes, duties, or import fees applicable to your order.
4. Payment
We accept the payment methods displayed at checkout. Payment is processed by our payment processors; by providing payment information you represent and warrant that you are authorized to use the payment method. We do not store full payment card data on our servers.
5. Shipping & Delivery
We ship domestically and internationally. Delivery times are estimates and may vary. You are responsible for providing accurate shipping information. International customers may be responsible for customs duties, taxes, or brokerage fees; these charges are not included in our product prices or shipping estimates.
6. Fulfillment
Some merchandise is fulfilled directly from our studio (for example CDs and vinyl) and some items are produced and shipped by third-party fulfillment providers. Regardless of who fulfills the order, we are responsible for customer service related to your order. If an item is lost, damaged, or defective, contact us at support@willdempseymusic.com and we will help resolve the issue.
7. Returns & Refunds
Our return and refund policy is posted separately on the Site (Refund/Return Policy). That policy explains eligibility, timeframes, and how to request a return or refund.
8. Intellectual Property
All content on the Site — including text, images, logos, audio, and designs — is owned or licensed by us and protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works from our content without our prior written permission.
9. User Content
If you post reviews, photos, or other content on the Site, you grant us a worldwide, royalty-free, perpetual, transferable license to use, reproduce, and display that content in connection with the Site and our business (including marketing). Don’t post content you don’t own or that violates someone else’s rights.
10. Prohibited Conduct
When using the Site you must not: impersonate others, post unlawful or infringing content, attempt to interfere with the Site’s operation, or engage in fraudulent activity. We may suspend or terminate accounts or refuse service for violations.

14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASES FROM US. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THESE TERMS OR YOUR ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THE GOODS GIVING RISE TO THE CLAIM.
15. Indemnification
You agree to indemnify and hold us harmless from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising from your breach of these Terms or your use of the Site.

17. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Louisiana, without regard to choice-of-law rules. You agree that any legal action related to these Terms or the Site shall be brought exclusively in the state or federal courts located in New Orleans, Louisiana.
18. Changes to Terms
We may update these Terms from time to time. Changes take effect when posted on this page with a revised effective date. Your continued use of the Site after changes are posted constitutes acceptance of the new Terms.
19. Severability
If a court finds any provision of these Terms invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force.

These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and us regarding the Site and supersede any prior agreements.
